Chapter 7 bankruptcy

Chapter 7 bankruptcy involves the liquidation of assets to pay off creditors and is frequently filed by individuals, married couples, and small businesses.  It is the simplest, most common type of bankruptcy.  As established in the Bankruptcy Abuse Prevention and Consumer Protection Act of 2005, prospective filers must take a means test to determine their eligibility for chapter 7 bankruptcy.  Debtors are granted an automatic stay immediately after filing a bankruptcy petition.  You must then attend a 341 meeting of creditors, when the court's chosen trustee questions you under oath about your property, assets, and debts. 

Chapter 13 bankruptcy

Chapter 13 bankruptcy is typically filed by individuals and sole proprietors who do not qualify for Chapter 7 under the means test.  It allows you to keep the majority of your assets as long as you are able to pay off your debts over the course of three to five years.  Chapter 13 bankruptcy is beneficial if you have significant assets you do not want to liquidate or non-dischargeable debts you must continue paying. 

Chapter 13 filers often have:

  • Outstanding taxes, child support, and student loans
  • Mortgages or loans on homes and other large property
  • Delinquent mortgage payments
  • Delinquent automobile loans
